Terms of Service

1. Agreement to Terms

By accessing or using Bubblybards ("the Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Platform.

Eligibility: You must be at least 13 years old to use this Platform. If you are under 18, you must have parental or guardian consent.

2. Description of Service

Bubblybards is a platform for creating, organizing, sharing, and monetizing Dungeons & Dragons content. We provide:

• Content creation tools (text editor, templates, blocks)
• AI-powered content generation (see Section 2.5)
• Content organization (nested pages, tags, search)
• Community features (comments, discussions, followers)
• Monetization tools (subscriptions, revenue sharing)
• Storage for images and content

We reserve the right to modify, suspend, or discontinue any part of the Platform at any time without notice.

2.5 AI Generation Features

Bubblybards offers AI-powered content generation using Claude 3.5 Sonnet ("AI Service"):

2.5.1 AI Credits

• Free Tier: No AI credits included
• Creator Tier ($5/month): 100 AI credits per month
• Master Creator Tier ($15/month): Unlimited AI credits
• Credit Costs:
  • Text generation: 1 credit per generation
  • Image generation: 5 credits per generation
• Refills: Additional credits can be purchased ($5 for 100 credits)
• Expiration: Monthly credits reset on your billing date; purchased credits never expire
• Caching: Identical prompts may return cached results at no credit cost

2.5.2 AI Content Ownership

• You own all AI-generated content created through Bubblybards
• The AI Service provider (Anthropic) does NOT claim ownership of your generated content
• AI-generated content is subject to the same ownership rules as user-created content (Section 6)

2.5.3 AI Training & SRD Compliance

• Our AI is instructed to follow the D&D 5th Edition Systems Reference Document 5.1 (SRD 5.1)
• AI-generated content follows official D&D mechanics and lore from the SRD
• We do NOT train custom AI models on copyrighted D&D content outside the SRD
• You are responsible for ensuring your prompts don't request copyrighted content
• Our AI filters block prompts requesting copyrighted monsters, settings, and content

2.5.4 Context-Aware Generation & Privacy

When you use AI features, you can optionally enable context-aware generation, which allows the AI to read related pages for better results:

• Current Page: The AI can read content from the page you're editing
• Parent Page: The AI can read the page above the current page (e.g., campaign overview)
• Sibling Pages: The AI can read other pages at the same level (up to 5)
• Child Pages: The AI can read pages nested under the current page (up to 5)

🔒 PRIVACY GUARANTEE: The AI ONLY reads YOUR OWN pages. It will never read private pages from other users. When you enable context features, the AI only accesses pages that:

• Are owned by you (created by your account)
• You have explicitly chosen to include via checkboxes in the AI modal

Private pages remain private. Even if you reference a private page in a prompt, the AI cannot access it unless you own that page and enable context features.

2.5.5 AI Content Accuracy

AI-generated content is provided "AS IS" without guarantees of accuracy, balance, or quality.

• We do not verify that AI content is mechanically balanced or lore-accurate
• You are responsible for reviewing and editing AI-generated content before use
• We are not liable for errors, bugs, or issues in AI-generated content
• AI may occasionally generate content that is unbalanced, inappropriate, or incorrect
• Always review AI content before using it in your games or sharing it publicly

2.5.6 Prohibited AI Use

You may NOT use our AI features to:

• Generate illegal, harmful, or NSFW content (we filter these prompts)
• Circumvent our content policies or copyright restrictions
• Generate copyrighted D&D content (Mind Flayers, Beholders, official settings, etc.)
• Abuse the AI service (excessive requests, prompt injection attacks, etc.)
• Attempt to extract or reverse-engineer the AI model
• Use AI-generated content for commercial purposes outside Bubblybards (you can monetize ON the platform)

2.5.7 AI Service Availability

• AI features may be temporarily unavailable due to outages, maintenance, or rate limits
• We reserve the right to modify AI features, models, or costs with 30 days' notice
• We may limit AI usage if you abuse the service or violate these Terms
• Cached results (30-day expiration) may be returned for identical prompts

3. User Accounts

Account Creation: You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the security of your account credentials.

Account Termination: We reserve the right to suspend or terminate accounts that violate these Terms or our Community Guidelines without prior notice.

Your Responsibility: You are solely responsible for all activity on your account. Notify us immediately of any unauthorized access.

4. Subscription Tiers

4.1 Free Tier

• 50 MB image storage per month (resets monthly)
• Unlimited public and private pages
• Access to 5 core templates and blocks
• Community features (comments, favorites, following)
• No AI credits included

4.2 Creator Tier ($5/month)

• 500 MB image storage per month
• 100 AI credits per month (text and image generation)
• Access to all premium templates and blocks
• Create and share custom templates
• PDF export, analytics, Creator badge
• Discord community access

4.3 Master Creator Tier ($15/month)

• 5 GB image storage per month
• Unlimited AI credits (text and image generation)
• Monetize your content (charge for subscriptions)
• Share read-only links (no account required)
• Import tool for content migration
• Revenue sharing: Keep 95%, we take 5%
• Priority support and early access to features

Billing: Subscriptions are billed monthly via Stripe. All fees are non-refundable except as required by law. You may cancel at any time; access continues until the end of the billing period.

Price Changes: We may change subscription prices with 30 days' notice. Existing subscribers will be grandfathered at their current price for 12 months.

5. Content Monetization (Master Creator Tier)

5.1 Revenue Sharing

Master Creators may charge users for access to their content. Revenue is split as follows:

• Creator receives: 95% of subscription revenue (after payment processing fees)
• Platform fee: 5% of subscription revenue
• Payment processing: Stripe charges approximately 2.9% + $0.30 per transaction

5.2 Payouts

Creators must connect a Stripe account to receive payouts. Payouts are processed weekly or daily (per your Stripe settings). We are not responsible for delays caused by your bank or Stripe.

5.3 Taxes

You are solely responsible for all taxes on your earnings. We do not withhold taxes. You may receive tax forms (1099-K in the US) from Stripe if you earn over the reporting threshold.

5.4 Refunds & Chargebacks

Refund Policy: All subscription payments are non-refundable. Subscribers may cancel at any time and retain access until the end of their billing period.

Chargebacks: If a subscriber initiates a chargeback, you may lose access to those funds. Excessive chargebacks may result in account suspension.

5.5 Creator Responsibilities

As a monetizing creator, you agree to:

• Provide the content and services you advertise
• Not engage in fraud, misleading claims, or deceptive practices
• Comply with all applicable laws (consumer protection, tax, etc.)
• Respond to subscriber inquiries in a timely manner
• Not use the Platform to sell illegal, prohibited, or infringing content

6. Content Ownership & Licensing

6.1 Your Content

You retain all ownership rights to content you create and upload. By uploading content to Bubblybards, you grant us a worldwide, non-exclusive, royalty-free license to:

• Store, display, and distribute your content on the Platform
• Create backups and derivative formats (thumbnails, previews)
• Allow other users to view, comment on, and share your public content

This license terminates when you delete your content or account, except for content that has been shared or cached.

6.2 D&D 5e SRD Content & Open Game License

Dungeons & Dragons 5th Edition Content: Bubblybards includes templates and content based on the D&D 5th Edition Systems Reference Document 5.1 (SRD 5.1), which is available under the Creative Commons Attribution 4.0 International License (CC BY 4.0).

What You Can Use:

• Game mechanics (ability scores, saving throws, combat rules)
• SRD races, classes, monsters, spells, and magic items
• Rule references and stat block formats

What You CANNOT Use (Still Copyrighted by Wizards of the Coast):

• Non-SRD monsters (e.g., Mind Flayers, Beholders, Displacer Beasts)
• Specific campaign settings (Forgotten Realms, Eberron, Ravenloft)
• Official adventure modules and their content
• Official artwork and illustrations
• The D&D logo and trademarks

Your Responsibility: When creating content using SRD material, you agree to:

• Not claim ownership of SRD content
• Not use copyrighted D&D content outside the SRD
• Follow the Creative Commons CC BY 4.0 license terms
• Include proper attribution if required by the license

Platform Templates: Our AI-powered templates and formatting tools are provided to help you create SRD-compatible content. We do not endorse or verify that user-generated content complies with the SRD or copyright laws.

6.3 Third-Party Content & Copyright

You represent and warrant that you own or have the necessary rights to all content you upload. You may not upload copyrighted material without permission.

DMCA Policy: We comply with the Digital Millennium Copyright Act. If you believe content infringes your copyright, email us at hello@bubblybards.com with:

• Description of the copyrighted work
• URL of the infringing content
• Your contact information
• Statement of good faith belief
• Signature (physical or electronic)

6.4 Platform Content

All templates, blocks, design elements, and software on Bubblybards are owned by us and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute our Platform code or design.

7. Prohibited Conduct

You may not:

• Violate any laws or regulations
• Harass, threaten, or abuse other users
• Upload illegal, obscene, or harmful content
• Infringe on others' intellectual property rights (including D&D copyrights outside the SRD)
• Impersonate others or misrepresent your affiliation
• Spam, phish, or distribute malware
• Scrape, crawl, or reverse-engineer the Platform
• Circumvent security measures or access restrictions
• Engage in fraud or payment manipulation
• Use the Platform to sell or promote illegal goods/services
• Abuse AI features (prompt injection, excessive requests, bypassing filters)

Violation of these terms may result in immediate account termination and legal action.

8. Privacy & Data Protection

We take your privacy seriously. Our Privacy Policy explains how we collect, use, and protect your data.

8.1 GDPR Compliance (EU Users)

If you are in the European Union, you have the following rights:

• Right to Access: Request a copy of your personal data
• Right to Rectification: Correct inaccurate data
• Right to Erasure: Delete your account and data
• Right to Data Portability: Export your content
• Right to Object: Opt-out of marketing emails

8.2 Cookies

We use cookies for authentication, preferences, and analytics. By using the Platform, you consent to our use of cookies. You can disable cookies in your browser settings, but this may affect functionality.

9. Disclaimers & Limitation of Liability

9.1 "AS IS" Service

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not guarantee that the Platform will be error-free, secure, or uninterrupted.

9.2 User Content

We are not responsible for user-generated content. We do not endorse, verify, or guarantee the accuracy of user content. You use the Platform and interact with other users at your own risk.

9.3 AI-Generated Content

AI-generated content is provided "AS IS" without warranties. We do not guarantee that AI content is accurate, balanced, or suitable for use. You are solely responsible for reviewing and using AI-generated content.

9.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability is limited to the amount you paid us in the past 12 months (or $100, whichever is greater)
• We are not liable for third-party services (Stripe, Cloudflare, Supabase, Anthropic, etc.)
• We are not liable for lost profits, data, or content
• We are not liable for errors or issues in AI-generated content

9.5 Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including legal fees) arising from:

• Your use of the Platform
• Your content (copyright infringement, defamation, etc.)
• Your violation of these Terms
• Your violation of any third-party rights (including D&D copyright outside the SRD)
• Your use of AI-generated content

10. Dispute Resolution

10.1 Governing Law

These Terms are governed by the laws of Denmark, without regard to conflict of law principles.

10.2 Arbitration (US Users)

For US users: Any disputes will be resolved through binding arbitration under the rules of the American Arbitration Association, rather than in court. You waive your right to a jury trial and class action lawsuits.

Exception: Either party may seek injunctive relief in court for intellectual property violations.

10.3 EU Users

EU users may file disputes through the EU Online Dispute Resolution platform: ec.europa.eu/consumers/odr

11. Changes to Terms

We may update these Terms at any time. Material changes will be notified via email or a prominent notice on the Platform at least 30 days before taking effect.

Continued use of the Platform after changes take effect constitutes acceptance of the new Terms.

12. Termination

You may delete your account at any time from your settings page. Upon deletion:

• Your content will be removed (except cached copies)
• Your subscription will be canceled (no refunds)
• Your data will be deleted within 30 days (GDPR compliance)
• Your AI prompts and cached results will be deleted within 30 days

We may suspend or terminate your account immediately if you violate these Terms or our Community Guidelines, with or without notice.

13. Miscellaneous

Entire Agreement: These Terms, along with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and Bubblybards.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect.

No Waiver: Our failure to enforce any provision does not constitute a waiver of that provision.

Assignment: You may not transfer your account or rights under these Terms. We may assign our rights to a successor or affiliate.
